Compass Beta service terms.

Effective 9 October 2026. These Terms form an agreement between you and Blue Top Consulting, of <registered address>, for your use of Blue Top Compass (“Compass”).

Eligibility and authority

You must be legally capable of entering this agreement. If you use Compass for an organisation, you confirm that you have authority to bind it. You are responsible for accurate account information, secure access to your email and account, and all activity under your account.

Beta service

Compass Beta is a controlled, invite-only, pre-release service for automated outside-in assessment of publicly reachable software. It is subject to change, may contain defects or be unavailable, and may change its checks, evidence and report output without notice. We may impose quotas, alter or discontinue beta features, or end the beta.

Permitted use and target authority

You may assess a target only where you have sufficient authority, permission or another lawful basis. Public accessibility alone does not establish authorisation. The Acceptable Use Policy forms part of these Terms.

Organisation accounts

Organisation owners and administrators may manage membership and access. Members may see organisation assessment material according to their role. You must remove access promptly when a person no longer requires it and must not share invitations or account access.

Confidentiality and assessment data

Each party must protect the other party’s non-public information using reasonable care and use it only for this agreement. Compass processes targets, evidence and reports to provide and secure the service as described in the Privacy Notice. Confidentiality does not cover information that is public without breach, independently developed, lawfully received without restriction, or required to be disclosed by law.

Reports and limitations

Compass outputs are informational technical observations from a bounded point-in-time assessment. They are not penetration tests, certifications, formal audits, compliance opinions, legal opinions, or guarantees that defects or vulnerabilities are absent. Coverage and results can be affected by availability, network conditions, target behaviour, browser challenges and third-party services. You remain responsible for decisions made using a report and for obtaining specialist advice where appropriate.

Third-party services

Compass depends on hosting, database, authentication, email and hosted-browser providers. Their interruption or change may affect the service. Links and observed third-party content remain the responsibility of their respective operators.

Intellectual property and report licence

Blue Top Consulting and its licensors retain rights in Compass, its methodology, software and materials. Subject to these Terms, we grant you a non-exclusive licence to use and share reports created for your account for legitimate internal and professional purposes. You must preserve report limitations and may not misrepresent, resell or use reports to imply certification without written permission.

Feedback

If you provide feedback, you grant us a perpetual, worldwide, royalty-free right to use it to improve Compass without identifying you or disclosing your confidential information.

Suspension and termination

We may suspend or terminate access for breach, misuse, security or legal risk, non-cooperation with an incident, service protection, or discontinuation of the beta. You may stop using Compass at any time. After termination, access ends; data is deleted or retained according to the Privacy Notice, legal requirements and backup cycles. Terms intended to survive termination—including intellectual property, disclaimers, liability and disputes—continue to apply.

Warranties and disclaimers

To the fullest extent permitted by law, Compass Beta is provided “as is” and “as available”, without implied warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, accuracy or completeness. Nothing excludes a warranty or remedy that applicable law does not permit us to exclude.

Liability

To the fullest extent permitted by law, neither party is liable for indirect, incidental, special, punitive or consequential loss, or loss of profit, revenue, goodwill, opportunity or data. Blue Top Consulting’s total aggregate liability arising from Compass is limited to <approved liability wording>. This cap and the exclusions do not apply where liability cannot lawfully be limited, including liability for fraud or wilful misconduct. Consumer and other mandatory statutory rights remain unaffected.

Indemnity

To the extent permitted by law, you will defend and indemnify Blue Top Consulting against third-party claims caused by your unauthorised target assessment, unlawful use, or material breach of the Acceptable Use Policy, except to the extent caused by our breach or misconduct.

Governing law and disputes

These Terms are governed by <approved governing law>, without regard to conflict-of-law rules. The parties submit to <approved jurisdiction>. Before formal proceedings, each party should give written notice and allow 30 days for good-faith resolution, unless urgent relief is reasonably required.

Changes and communications

We may update these Terms by publishing a new version and effective date. Material changes require acceptance before continued product access. You agree to receive account, legal, security and service communications electronically at your account email.

General

If a provision is unenforceable, it is adjusted only as necessary and the remainder continues. Failure to enforce a provision is not a waiver. You may not assign this agreement without our consent; we may assign it as part of a reorganisation or transfer of the service. These Terms, the Acceptable Use Policy and documents expressly incorporated into them are the entire agreement about Compass Beta.
